When it comes to eligibility, illegal status in a third country will not at all render an individual to immigrate to Canada, unless a case of criminality is involved.

(i) the applicant has at any point resided lawfully in the past in that country for at least a period of one year or more, OR

In any of these conditions is not fulfilled, the documentation must be filed with the Canadian visa office which normally serves the applicant’s home country/ habitual residence country /country of citizenship.
